Terms and Conditions

§ 1 Subject Matter of the Agreement
These Terms and Conditions govern the use of the SaaS platform “Hab so Hunger” (hereinafter the “Service”), operated by Oliver Frickenstein, Am Diekpoal 17, 33428 Harsewinkel (hereinafter the “Provider”), by commercial users (hereinafter the “Customer”). The Service enables restaurant operators to digitally manage orders, menus, payments, marketing, and analytics.
§ 2 Scope of Services
The Provider makes the platform available to the Customer in the respective selected pricing tier (Starter, Pro, Business). The exact scope of features per tier is set out in the current service description at habsohunger.de/preise. Any reduction of material features will be announced to the Customer at least 30 days in advance.
§ 3 Prices and Payment Terms
Use of the Service is subject to a fee after the 30-day trial period ends. The tiers are: Starter 29 €/Monat, Pro 49 €/Monat, Business 79 €/Monat (all prices plus statutory VAT). Billing is carried out monthly in advance. A commission on orders is never charged.
§ 4 Contract Term and Termination
The contract is concluded for an indefinite period and may be terminated by either party in text form (email) with one month's notice to the end of the respective billing month. The right to extraordinary termination for good cause remains unaffected.
§ 5 Customer Obligations
The Customer undertakes to provide only accurate information, to keep access credentials confidential, and not to misuse the Service. The Customer is responsible for all content (menu, texts, images) published via the Service.
§ 6 Availability and Maintenance
The Provider aims for an availability of the Service of 99 % on annual average. Excluded from this are scheduled maintenance work as well as outages for which the Provider is not responsible.
§ 7 Limitation of Liability
The Provider is liable without limitation for intent and gross negligence as well as for injury to life, body, or health. Otherwise, liability is limited to typical, foreseeable damage and capped at the amount of usage fees paid in the relevant month.
§ 8 Data Protection
The processing of personal data is governed by the Provider's privacy policy, available at habsohunger.de/datenschutz.
§ 9 Changes to these Terms
The Provider reserves the right to change these Terms and Conditions with at least 30 days' notice. Changes will be communicated to the Customer by email. If the Customer does not object within 30 days, the amended Terms are deemed accepted.
§ 10 Final Provisions
German law applies, excluding the CISG (UN Convention on Contracts for the International Sale of Goods). To the extent legally permissible, the place of performance and jurisdiction is Harsewinkel. Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
